Terms of Service

The terms and responsibilities that apply when you use HMS.

Acceptance of Terms

By accessing or using HMS ("the Platform"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Platform. These terms apply to all users — clinic owners, doctors, nurses, receptionists, and any other staff members.

Description of Service

HMS is a cloud-based clinic management platform that provides:

  • Patient registration and electronic medical records.
  • Appointment scheduling and doctor availability management.
  • Prescription generation (PDF) with clinic letterhead.
  • Staff management with role-based access control.
  • Vitals recording, medical history tracking, and visit timelines.

Account Responsibilities

  • You are responsible for maintaining the security of your account credentials.
  • The clinic owner (Organization Owner) is responsible for managing staff access and permissions.
  • You must not share login credentials between users — each staff member must have their own account.
  • You must provide accurate information during registration.

Acceptable Use

You agree not to:

  • Use the Platform for any unlawful purpose.
  • Attempt to access another clinic's data.
  • Reverse-engineer, decompile, or attempt to extract the source code.
  • Use automated systems (bots, scrapers) to access the Platform.
  • Upload malicious content or attempt to compromise system security.

Data Ownership

Your clinic owns its data. Patient records, appointment data, prescriptions, and all clinical information entered into the Platform remain your property. We do not claim ownership of your data. You grant us a limited license to store, process, and display your data solely for the purpose of providing the Platform's services to you.

Service Availability

We aim for 99.9% uptime but do not guarantee uninterrupted access. Scheduled maintenance will be communicated in advance. We are not liable for downtime caused by factors outside our control (internet outages, cloud provider issues, force majeure).

Pricing & Payment

HMS offers a free tier for small clinics. Paid plans may be introduced in the future with advance notice. Any pricing changes will not affect existing commitments retroactively.

Termination

  • You may close your account at any time by contacting us.
  • We may suspend or terminate accounts that violate these terms.
  • Upon termination, we will provide a reasonable window to export your data.
  • Clinical data may be retained as required by applicable medical record retention laws.

Limitation of Liability

HMS is a management tool — it does not provide medical advice, diagnosis, or treatment. Clinical decisions are the responsibility of qualified healthcare professionals using the Platform. We are not liable for clinical outcomes. To the maximum extent permitted by law, our liability is limited to the fees paid by you in the 12 months preceding the claim.

Governing Law

These terms are governed by the laws of India. Any disputes will be subject to the exclusive jurisdiction of courts in Jaipur, Rajasthan.

Changes to Terms

We may update these terms from time to time. Significant changes will be communicated to registered users via email at least 30 days before taking effect. Continued use after changes constitutes acceptance.
